Please read these Terms and Conditions ("Terms") carefully before using Easy Caption Pro ("the App"), a macOS application made by Easy App Company, United Kingdom ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal or commercial purposes on devices you own or control, subject to these Terms and the Apple Licensed Application End User Licence Agreement (EULA). Apple's Standard EULA is the licence for the App. These Terms add to it; where they differ, the Standard EULA applies.
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse-engineer or attempt to extract the source code of the App
- Use the App for any unlawful purpose
- Remove or alter any proprietary notices or labels on the App
2. Subscriptions and Purchases
Easy Caption Pro offers the following purchase options through the Mac App Store:
- Monthly Subscription: £6.99 per month, billed monthly through Apple. The subscription auto-renews unless cancelled at least 24 hours before the end of the current billing period.
- Lifetime Purchase: £39.99 at launch (regular price £49.99), one payment that unlocks every feature in the App, including those added in later updates, with nothing more to pay.
These are UK prices. The Mac App Store shows the price for your country, in your local currency.
There is no free trial; you need one of these plans to use the App. Payment is charged to your Apple Account when you confirm the purchase. Manage or cancel a subscription in your Apple Account settings; Apple tells you before a subscription price changes. If you reinstall the App, or use another Mac with the same Apple Account, choose Restore Purchases in the App.
All purchases are processed by Apple and are subject to Apple's terms and conditions. We do not process any payments ourselves. Refund requests go to Apple, at reportaproblem.apple.com.
3. Intellectual Property
The original design, graphics, user interface, and code written by us are owned by us and protected by applicable copyright laws.
The App incorporates third-party and open-source components (including OpenAI Whisper, Meta Omnilingual ASR, WhisperKit and FluidAudio; they are listed under About Easy Caption Pro in the App) which remain the property of their respective authors and are subject to their own licence terms. Nothing in these Terms grants you rights beyond those provided by the applicable open-source licences for such components.
Content you create using the App (captions, exported videos, presets) remains your property. We claim no ownership over your content.
4. User Responsibilities
You are responsible for:
- Ensuring you have the right to use any video, audio, or other media you import into the App
- Complying with all applicable laws when creating and distributing captioned content
- Maintaining backups of your project files and exported content
5. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Transcription accuracy depends on audio quality and language and is not guaranteed.
6. Limitation of Liability
To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from or relating to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
Nothing in these Terms limits your legal rights as a consumer, or our liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't let us limit.
7. Termination
Your licence ends automatically if you break these Terms. Sections relating to intellectual property, disclaimers, limitations of liability, and governing law survive termination.
8. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of England and Wales. If you are a consumer, you keep the protection of the laws of the country where you live, and you can bring a claim in your local courts.
